Terms of Service

1. Acceptance of terms

By creating an account or using the Nasca service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users of the Service, including those on free plans.

2. Description of service

Nasca provides a software-as-a-service platform that enables developers to track AI token usage, enforce per-user spend limits, and monetise end-user AI consumption within their own applications. The Service includes a dashboard, an edge API, an npm SDK package, and a hosted upgrade prompt shown to end-users when they reach a configured limit.

3. Account responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account
  • Ensuring your use of the Service complies with applicable laws
  • Promptly notifying us of any unauthorised use of your account

You must be at least 18 years old to use the Service.

4. Acceptable use

You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to circumvent plan limits or reverse-engineer the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to process data belonging to third parties without their consent
  • Resell or sublicense the Service without our prior written consent

5. Plans and payment

Free plan. The free plan is provided as-is with no payment required. We reserve the right to modify free plan limits at any time with reasonable notice.

Paid plans. Paid plans are billed monthly in advance via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Cancellation. You may cancel your subscription at any time. Your plan will remain active until the end of the current billing period; no partial refunds are issued for unused time.

Refunds. We offer refunds at our discretion for genuine billing errors. Contact hello@nasca.dev within 7 days of a charge if you believe an error occurred.

5a. Monetisation features and platform fee

Nasca provides optional monetisation features that allow you to collect payments from your own end-users through credit pack purchases and subscription plans. These features require connecting a Stripe account via Stripe Connect.

Platform fee. Nasca charges a 2% platform fee on the gross amount of each qualifying monetisation event: credit pack purchases and first-month subscription payments processed through a Nasca-hosted checkout session. This fee is deducted automatically as a Stripe application fee at the time of payment. Recurring subscription renewals after the first month are not subject to the Nasca platform fee.

You are the merchant on record. Payments from your end-users are processed by Stripe on your connected Stripe account. Nasca is not a party to those transactions. You are solely responsible for complying with Stripe's Connected Account Agreement, applicable payment laws, and for handling any refunds or disputes with your end-users.

Stripe Connect. By connecting a Stripe account, you agree to Stripe's Connected Account Agreement and the Stripe Services Agreement. Nasca requests access to create checkout sessions and receive webhooks on your behalf. You may disconnect your Stripe account at any time from Settings, which will disable monetisation features.

5b. End-user responsibilities

When you use Nasca's upgrade prompt or monetisation features, your end-users interact with a Nasca-hosted page displayed within your application. You are responsible for:

  • Disclosing to your end-users that their AI usage is tracked and may result in being blocked or prompted to pay
  • Ensuring your end-users are of sufficient age to enter into payment transactions in their jurisdiction
  • Providing your end-users with accurate descriptions of the credit packs and subscription plans you configure
  • Handling refunds, disputes, and customer support for payments made by your end-users through the Nasca-hosted checkout

Nasca is not responsible for any claims arising from your end-users regarding the products or services they pay for through the monetisation features.

6. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance at any time. The Service is provided "as is" without warranties of any kind, express or implied. Your use of the Service is at your sole risk.

7. Intellectual property

The Service, including its software, design, and content, is owned by Nasca and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. You retain ownership of any data you submit to the Service.

8. Limitation of liability

To the maximum extent permitted by law, Nasca shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits or data. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Termination

We may suspend or terminate your account immediately if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service or other users. You may close your account at any time from the dashboard settings. Upon termination, your right to use the Service ceases immediately.

10. Changes to these terms

We may update these Terms from time to time. We will provide at least 14 days' notice via email before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
